1. Terms
Website – The website on the Internet at https://veroarte.ru/
Administrator – Individual Entrepreneur Sergey Nikolaevich Nikitin
User – An individual who visits the Website or completes Registration
Buyer’s Account – A personalized section of the Website accessible to the User upon entering a login and password
Registration – The process of entering User data into a specific form on the Website to create a Buyer’s Account
Contact Information – Details provided by the User during Registration, specifically:
surname, name, patronymic;
phone number;
email address.
Goods – Products offered for sale on the Website
Order – A User’s request to purchase and deliver Goods, placed using methods provided by the Administrator
Pre-Order – A User’s request to purchase Goods within the timeframe specified on the Website
Content – Copyrighted objects placed by the Administrator on the Website to provide information about Goods and for advertising, including:
information;
design elements;
texts;
graphic images;
illustrations;
videos;
photos;
other objects
Materials – A publication posted by the User on a social network, containing one or more photographic works, one or more audiovisual works, and/or text
Recommendation Technologies – Information technologies that provide information based on the collection, systematization, and analysis of data related to the preferences of Users located in the Russian Federation
Discount – A reduction in the price of Goods, provision of a promo code, coupon, or similar, allowing the User to purchase Goods at a reduced cost
Useful Information – Information that encourages the User to perform a Target Action and/or increases their loyalty to the Seller (e.g., information about new collections or promotions)
Trigger Action – A User action that serves as a signal for a response in the form of a Recommendation
Target Action – Making a purchase or another action in which the Seller is interested
Recommendation – Providing the User with a Discount and/or Useful Information based on the User’s Trigger Actions and/or segmentation of Users according to their characteristics and preferences
2. General Provisions
2.1. This User Agreement defines the terms of use of the Website.
2.2. The Administrator is the owner of the Website.
2.3. The User confirms agreement with the User Agreement from the moment they begin using the Website.
2.4. The processing of Users’ personal data is governed by the Privacy Policy, posted on the Website at: https://veroarte.ru/termsofuse.
3. Creation of Buyer’s Account
Registration on the Website
3.1. To access certain Website features, the User may complete Registration.
3.2. The User may, without Registration, place a Pre-Order or Order, leave a review on the Website, or use the Website in other ways.
3.3. For Registration on the Website, the User:
3.3.1. provides their Contact Information;
3.3.2. creates a password.
3.4. Upon completion of Registration, the login and password are automatically sent to the email address provided by the User during Registration.
3.5. Subsequent access to the Buyer’s Account is obtained by entering the login and password.
3.6. The User uses the email address provided during Registration as the login.
Confidentiality of Login and Password
3.7. The User is responsible for maintaining the confidentiality of their Buyer’s Account login and password.
3.8. The User is responsible for all actions performed while using the Website under their account.
3.9. All actions performed within or using the Website’s services under the User’s account are deemed performed by the User.
3.10. The User must immediately notify the Administrator of any unauthorized access to their Buyer’s Account by third parties via email: info@veroarte.ru.
4. Permitted Use of the Website
4.1. The User may use the Website in the following ways:
4.1.1. browse the Website and catalog of Goods;
4.1.2. add Goods to the “Favorites” section;
4.1.3. place an Order for Goods;
4.1.4. place a Pre-Order for Goods;
4.1.5. leave reviews on the Website;
4.1.6. use other Website functionalities.
4.2. In the Buyer’s Account, the User can:
4.2.1. view the history and status of Orders;
4.2.2. view the history and status of Pre-Orders;
4.2.3. specify or change the delivery address;
4.2.4. view available discounts and bonuses;
4.2.5. update their Contact Information;
4.2.6. use other functionalities of the Buyer’s Account.
4.3. The User may not:
4.3.1. provide false information about themselves on the Website or in the Buyer’s Account;
4.3.2. impersonate another person or representative of an organization without sufficient authority;
4.3.3. perform actions that disrupt the Website’s operation;
4.3.4. post or distribute through the Website any information that, in the Administrator’s opinion, is undesirable, infringes the interests of the Administrator, other Users, or third parties.
5. Reviews on the Website
5.1. The User may leave a review on the Website regarding the quality of Goods, customer service, or delivery services.
5.2. The Administrator publishes reviews on the Website in the “Reviews” section.
5.3. The User may leave a review without publication.
5.4. To publish a review, the User selects the “Leave a Review” button in the “Reviews” section and, in the opened window:
5.4.1. selects a store rating from 1 to 5;
5.4.2. enters the review text;
5.4.3. provides their name, city, and email address;
5.4.4. clicks the “Submit Review” button.
5.5. The Administrator may monitor the Website’s content, including public sections, to ensure compliance of posted reviews with the Public Offer and Russian Federation legislation.
5.6. The Administrator may remove or not publish reviews containing:
5.6.1. profanity or slang;
5.6.2. threats, defamation, or insults;
5.6.3. racist statements or those inciting ethnic discord;
5.6.4. advocacy of hatred and/or discrimination, or critical statements regarding religion, politics, ethnicity, gender, personal qualities, abilities, sexual orientation, or appearance of third parties;
5.6.5. incitement to violence against any person or animal;
5.6.6. calls for illegal activities;
5.6.7. promotion of drug use, alcohol, or smoking;
5.6.8. malicious software (viruses, worms, trojans, or other computer codes, files, or programs);
5.6.9. links to third-party resources;
5.6.10. spam, i.e., unsolicited messages or calls for their further distribution;
5.6.11. advertisements for goods prohibited or restricted under Russian Federation legislation; lists of others’ email addresses; pyramid schemes, multi-level (network) marketing (MLM), offers to “join a club,” become a distributor, sales representative, “manager,” or other employee of a company whose business model relies on transferring funds from lower to higher levels, with compensation solely as a percentage of sales and/or requiring recruitment of other agents, distributors, “managers,” or “club members”; referral links; or internet earning systems and online businesses.
5.7. The Administrator does not verify reviews for violations of third-party rights to intellectual property or equivalent means of identification, or rights to confidential business information.
5.8. A rights holder who identifies a User review on the Website that infringes their rights may contact the Administrator via email: info@veroarte.ru.
6. Intellectual Property Rights to Content and Materials
Content
6.1. The Administrator and third parties are the rights holders of the Content.
6.2. The User may not transfer, sell, publish, move, reproduce, modify, adapt, or otherwise use the Content, in whole or in part, without the Administrator’s written permission.
Materials
6.3. The Administrator may publish Materials on the Website in which the User has included a link to the Administrator’s social media account @veroarte or the hashtag #Veroarte.
6.4. By including a link to the Administrator’s social media account @veroarte in Materials, the User consents and grants the Administrator the right to use the Materials under the following conditions:
6.4.1. The Administrator may use the Materials under a simple (non-exclusive) license;
6.4.2. method of use: posting Materials on the Website;
6.4.3. territory of use: worldwide;
6.4.4. duration of use: equal to the duration of the exclusive right to the Materials;
6.4.5. the Administrator may use the Materials free of charge.
6.5. The User grants the Administrator consent to use their image in Materials for the purpose of posting Materials on the Website.
6.6. The Administrator may:
6.6.1. publish Materials on the Website with or without indicating the User’s social media account name;
6.6.2. not include an active link to the User’s Materials on social media;
6.6.3. independently decide to use or cease using the Materials;
6.6.4. modify, adapt, or process the Materials for transmission, display, and distribution online, including alongside other Materials and/or advertisements;
6.6.5. transfer the Materials to partners for sale, distribution, or publication in other sources;
6.6.6. cease using the Materials and remove them from the Website at any time without explanation or notification to the User.
6.7. The User bears all risks associated with the publication of Materials on the Website.
6.8. The User, author, or rights holder of Materials may withdraw consent for their use by sending a request to the Administrator via email: info@veroarte.ru.
6.9. Individuals whose images are included in Materials may withdraw consent for the use of their images by sending a request to the Administrator via email: info@veroarte.ru.
6.10. The Administrator ceases using Materials and removes them from the Website within 7 business days from receiving the withdrawal of consent for the use of Materials or images.
7. Warranties
7.1. The User warrants that they:
7.1.1. are a legally capable person;
7.1.2. provided accurate information about themselves during Registration on the Website;
7.1.3. are the author or rights holder of the Materials or have obtained consent from the author or rights holder to publish and use the Materials as stipulated in the User Agreement;
7.1.4. have obtained consent from individuals depicted in the Materials for the use of their images.
7.2. The User warrants that the Materials:
7.2.1. do not violate Russian Federation legislation or the legally protected interests of third parties;
7.2.2. do not promote religious, racial, or ethnic discord;
7.2.3. are not obscene or offensive;
7.2.4. do not contain scenes of violence or drug advertisements;
7.2.5. are not pornographic;
7.2.6. do not violate the rights of minors;
7.2.7. do not infringe third-party copyrights or related rights;
7.2.8. do not contain overt commercial advertising of a trademark for goods not offered by the Administrator.
8. Liability
8.1. If the User violates the User Agreement, the Administrator may temporarily restrict the User’s access to the Website, and in case of serious and/or repeated violations, deny access to the Website.
8.2. The User is solely liable to third parties:
8.2.1. for their actions related to the use of the Website, including if such actions violate the rights and legitimate interests of third parties;
8.2.2. for compliance with legislation when using the Website’s services.
8.3. The User is solely liable for third-party claims regarding Materials and their content.
8.4. If third parties file claims against the Administrator regarding Materials and their content, the User must resolve such claims and/or lawsuits independently and at their own expense or fully reimburse the Administrator for losses caused by such claims.
8.5. The Administrator does not compensate the User for losses or pay compensation in case of third-party claims against the User regarding Materials and their content.
9. Marketing Communications
9.1. To promote Goods, the Administrator may send advertising and informational messages (hereinafter referred to as “marketing communications”).
9.2. The User may consent to receive marketing communications.
9.3. If consenting to marketing communications, the User provides their email address in the Website form and clicks the “Subscribe” button.
9.4. The Administrator sends marketing communications in the form of:
9.4.1. SMS messages and calls to the User’s phone number provided in the Website form or otherwise submitted to the Administrator;
9.4.2. messages to messengers linked to the User’s phone number;
9.4.3. emails to the email address provided in the Website form or otherwise submitted to the Administrator.
9.5. The User may opt out of receiving marketing communications at any time:
9.5.1. by following the unsubscribe link at the bottom of an email;
9.5.2. by sending a withdrawal of consent to the email address: info@veroarte.ru.
9.6. The User’s consent to marketing communications is valid from the moment it is given until it is withdrawn.
10. Recommendation Technologies
10.1. To encourage the User to perform a Target Action, additional incentives in the form of a Discount and/or Useful Information may be provided. Methods of providing incentives include:
displaying a special widget (visual element with information) on the Website;
sending an email message.
10.2. The User may receive a Recommendation if they:
perform a Trigger Action (e.g., leave an item in the cart and exit the Website, highlight a product name, etc.);
and/or are assigned to a specific segment (target group) based on their user characteristics and preferences (e.g., interest in a specific category of Goods).
10.3. The Administrator independently determines the conditions for providing Discounts and/or Useful Information.
10.4. Providing Recommendations requires information about the User’s actions on the Website, including data on viewed Goods, visited web pages, dates and times of visits, order placements, and purchases.
10.5. Technical information is also required, such as the User’s location, type, version, and language of the operating system and web browser, device type, screen resolution, and cookie data.
10.6. Sources of information include the Website and the User’s web browser.
10.7. Data collection is performed using tools such as tracking codes, APIs, user agents, and cookies.
10.8. Based on collected data, Trigger Actions are configured, and/or Users are segmented according to their characteristics and preferences. For example, a User visiting the Website for the first time may be shown a widget with a welcome Discount upon entering the Website (Trigger Action).
11. Final Provisions
11.1. This User Agreement takes effect upon its publication on the Website.
11.2. The Administrator may amend the terms of the User Agreement in whole or in part at any time. Amendments take effect upon their publication on the Website.
11.3. The Administrator is not obligated to notify the User of changes to the User Agreement.
11.4. Continued use of the Website after amendments to the User Agreement take effect confirms the User’s agreement with such changes.
11.5. The User may send suggestions or questions about the User Agreement to the Administrator via phone or email: info@veroarte.ru. Calls are accepted from 9:00 AM to 9:00 PM.
